Marriage and the Family Under Attack Again…This Time in New Jersey…

Radical homosexual activists continue their relentless search for a state that will legalize their dream of same-sex “marriage”…and allow them to force affirmation of homosexual behavior on the rest of the country. Their strategy is to file lawsuits in states with activist judges…in hopes of having the courts implement their agenda, rather than taking it to the people.

The latest effort is in the state of New Jersey, where homosexual activists won a major victory just three years ago in the Boy Scouts of America v. Dale (which, by God’s grace, was overturned by the U.S. Supreme Court), that would have forced the Scouts to admit homosexual leaders.

Seven same-sex “couples” have now filed suit, with the support of the Lambda Legal Defense and Education Fund, alleging that the New Jersey has violated its constitution’s equal protection clause by excluding same-sex “couples” from the same benefits given to legally married heterosexual couples. Based on the court’s prior slant, there is a good chance that the activists may emerge victorious.

Can you imagine New Jersey’s founders putting such a “right” into their state law? Yet, Sally Goldfarb, a professor at Rutgers University says: “New Jersey has a long tradition of willing to be forward-looking and progressive, and looking to the state constitution to recognize new rights. The fact that New Jersey family law already recognizes same-sex relations as legitimate in several areas lends support to the position that there is no justification for denying same-sex couples access to marriage.”

Bill Duncan of the ADF-allied organization, the Marriage Law Project added: “There are a number of people who are very upset about what’s going on [the legal push for same-sex marriage], but none of those people are on any of the courts in New Jersey.”

What is especially alarming is that the New Jersey Supreme Court already had a special “task force” for “gay and lesbian issues” which advocated “continuing education for judges and court employees, and communications to staff, litigants, and their attorneys on how to report bias or discrimination” when it comes to sexual orientation.

It is for battles such as these that the Alliance Defense Fund was founded…to make sure that God’s people do not lose by default and that traditional marriage and the family will be preserved.
